“In his ruling, U.S. District Choose Jed Rakoff of the Southern District of New York rejected Choose Torres’ distinction between institutional gross sales and gross sales to retail traders on crypto exchanges, which he characterised as a misinterpretation of the Howey check used to find out if an asset is a safety,” analysts led by Mark Palmer wrote.
